Terms of Service

1. Business details

These Terms apply to services and products supplied by MR. SHOEKARE, trading as MR.SK, ABN 67 532 549 233 (“MR.SK”, “we”, “us”).

Notices and customer contact: mr.shoekare@gmail.com. A residential address is not published on this website.

The registered business name and ABN also appear on formal quotes, order confirmations, invoices and receipts. They are not shown in the public website footer.

2. Our service

MR.SK coordinates product sourcing, supplier communication, purchasing arrangements, inspections where expressly included, and shipping arrangements from China to Australia. You submit a purchasing request. MR.SK investigates suppliers and provides a final written quote. After you approve that quote in writing, MR.SK arranges the approved purchase and shipping.

The exact product, service scope, providers, costs and delivery destination are stated in each written quote. Service scope, third-party providers and included costs are confirmed in that quote.

MR.SK is not the manufacturer, testing laboratory, customs broker, freight carrier or insurer unless a written quote expressly states otherwise. Those services are performed by the third parties identified or described in the quote. MR.SK remains responsible for performing its own services with due care and skill, and for obligations that cannot lawfully be excluded.

The quoted price is MR.SK’s final price. It is not described as a factory original price, a zero-markup price, or the supplier’s cost.

3. Quotes and pricing

A website estimate, public listing, filtered reference range or Cross Pilot result is not a supplier offer, landed cost or guarantee. Only a written MR.SK quote can be accepted as an order. Submitting a quote request does not place an order.

MR.SK sets its own final quoted price. It may include product cost, sourcing and communication, payment and currency risk, order administration, MR.SK’s commercial margin, and any other services expressly listed in the quote. Supplier cost and MR.SK’s margin are confidential and are not separately disclosed unless required by law.

A quote must state whether international freight, GST, duty, customs clearance, quarantine, inspection, insurance, storage, special delivery and other charges are included or excluded. Unlisted third-party charges are not included unless the quote says otherwise. We will seek approval before incurring a material additional charge that was not reasonably included in the accepted quote.

4. Payment

Submitting a quote request does not require payment and does not place an order. Payment terms, methods and timing are stated in the written quote. After you approve that quote, payment is made as specified in the quote. MR.SK then coordinates the approved purchase and shipping.

Refunds, cancellations and other money handling after acceptance depend on the quote, whether production or freight has begun, and applicable law, including the Australian Consumer Law.

5. Customer approval of specifications

The customer must check the product description, dimensions, material, colour, quantity, intended use, delivery address, inspection scope and other specifications before approving a quote. MR.SK will order against the approved written specifications. The customer is responsible for errors in information they supplied or approved, subject to applicable law.

Purchase terms are accepted when the customer approves the final written quote. They are not accepted merely by submitting a website enquiry.

6. Basic supplier and product checks

Unless the quote states otherwise, MR.SK performs reasonable basic checks using available business information and supplier-provided records. This is not a legal, financial, factory or product-compliance audit.

MR.SK does not describe a supplier as a verified factory, a guaranteed supplier, or fully compliant unless the corresponding review, audit or valid certification for that model is actually obtained and stated in the quote. Goods are not described as 100% quality checked.

MR.SK will not knowingly conceal a material issue identified during its work. MR.SK does not guarantee that a third party will never default or that supplier-provided information is error-free.

7. Samples, testing and inspection

Samples, laboratory testing, factory audits, certification verification and third-party pre-shipment inspections are included only when expressly stated in the final quote. If they are not listed, they are not included.

Where those services are included, they are performed by the providers identified in the quote. Manufacturing, professional testing, carriage, insurance and other third-party services remain the responsibility of those providers, as allocated in the quote and these Terms, subject to applicable law.

8. Product safety and restricted products

MR.SK may decline products that present elevated safety, regulatory, intellectual-property or insurance risk. Additional compliance documents, samples or third-party testing may be required before an order is accepted.

Nothing in these Terms removes any product-safety obligation imposed by law on MR.SK.

9. Import declaration and customs clearance

The party acting as importer of record, and the allocation of customs, quarantine, GST, duty and related compliance responsibilities, must be stated in the quote. Those responsibilities are not assumed to sit with MR.SK unless the quote expressly says so.

Customers must provide accurate information reasonably required for import, clearance and delivery. Delays, inspections, holds or additional charges imposed by customs, biosecurity or other authorities are outside MR.SK’s control. MR.SK will reasonably coordinate and pass on available information.

10. Estimated timing and delivery

Processing and delivery dates are estimates unless expressly described as guaranteed in writing. Timing may be affected by production, consolidation, customs, quarantine, carriers, weather and access to the delivery location.

The quote states the agreed delivery destination and service level. Delivery is arranged to that destination. It is not an unconditional door-to-door promise, and it is not limited to “arrival in Australia” if the quote includes a further delivery stage.

Special access, stairs, cranes, forklifts, storage, waiting time, redelivery and remote-area services are excluded unless stated. MR.SK will provide available tracking or progress updates through to the delivery stage confirmed in the quote. We do not display simulated tracking.

11. Transit insurance, damage and loss

The quote must state whether transit insurance is included and any declared-value or claim conditions. Customers should inspect deliveries as soon as reasonably practical and promptly provide photographs, packaging evidence and delivery records for a claim.

A suggested reporting period helps preserve supplier, carrier and insurance claims. It does not remove rights that cannot lawfully be excluded.

If goods are delayed, lost or damaged, MR.SK will reasonably assist with the relevant carrier or insurance claim and coordinate with the supplier where appropriate. Responsibility for a loss depends on the accepted quote, applicable transport or insurance terms, and applicable law.

Nothing excludes liability for MR.SK’s own fraud, wilful misconduct, failure to exercise due care and skill, or another liability that cannot lawfully be excluded.

12. Changes, cancellation and refunds

An enquiry may be cancelled before a quote is accepted. After acceptance, cancellation or specification changes depend on whether the supplier has begun production, purchased materials, dispatched goods or incurred other non-recoverable costs. MR.SK will disclose known non-recoverable amounts and refund any recoverable balance, subject to applicable law.

Change-of-mind returns are generally unavailable for custom-made or specifically sourced products. This does not affect remedies for defective, unsafe, materially misdescribed or otherwise non-compliant products.

13. Product issues and remedies

Contact MR.SK as soon as reasonably possible if goods arrive damaged, unsafe, incomplete, incorrect or materially different from the approved description. Include the order number and reasonable supporting evidence. Do not return goods until return instructions are provided.

Depending on the issue and applicable law, the remedy may include repair, replacement, refund, re-performance of a service, or another appropriate solution. Supplier or carrier policies do not override rights that apply against MR.SK.

MR.SK does not say that it is not responsible for any product issues, that the customer accepts all risks, that refunds are never available, or that the supplier is solely responsible for everything.

14. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any right, guarantee, remedy or liability that cannot lawfully be excluded, restricted or modified.

Where the law permits liability to be limited for a non-household business transaction, any limitation must be reasonable and will be stated in the accepted quote. MR.SK does not exclude liability for personal injury, fraud, wilful misconduct or reasonably foreseeable loss where exclusion is prohibited by law.

15. Cross Pilot and third-party market data

Cross Pilot provides full public market research data. MR.SK may filter likely outliers and non-comparable listings to create a practical sourcing reference. Those filtered ranges, public listings and research summaries are informational estimates only. They are not supplier offers, confirmed purchase costs or final quotes.

Market data may be incomplete, delayed or non-comparable. Customers must rely on the final written MR.SK quote for an order. Third-party sites operate under their own terms and privacy practices.

16. Privacy

Personal information is handled under the MR.SK Privacy Policy. Order information may be shared with suppliers, payment providers, inspection providers, customs and logistics providers only as reasonably required to provide the approved service or as otherwise disclosed in the Privacy Policy.

17. Governing law and disputes

These Terms are governed by the laws applicable in South Australia and Australia. Before commencing formal proceedings, both parties should first attempt to resolve the dispute by contacting mr.shoekare@gmail.com. This clause does not restrict a customer’s right to contact a regulator, tribunal or court.
